Terms and Conditions of Participation - Lidl Plus Survey Scheme

Lidl Great Britain Limited (hereinafter referred to as “Lidl”) is conducting a promotion called Lidl Plus survey for a chance to receive a digital reward coupon (referred to as the “Scheme”) which is only available to registered Lidl Plus Members (see https://www.lidl.co.uk/lidl-plus and the Help section of the Lidl Plus App for more information on Lidl Plus). By participating in the Scheme you will be deemed to have accepted these Terms and Conditions of Participation.

1) Entry Criteria

a) This Scheme is open to residents of the United Kingdom (excluding Northern Ireland) aged 18 years old and over who are registered Lidl Plus members and users of the Lidl Plus app (the Lidl Plus app can be downloaded from the " App Store" or on " Google Play") ("Participant" or "you").

b) The Scheme is not open to agents or any third party directly associated with the administration of the Scheme.

2) Participation

a) The Scheme will start on 15/09/2023 and end on 18/09/2023. The Scheme consists of a Survey (the "Survey") which runs between 00:01 on 15/09/2023 and 23:59 on 18/09/2023 (inclusive) (the "Survey Period").

b) To enter you must complete and submit the online Survey on the Lidl Plus App. Eligible Participants will receive an email showcasing Lidl Plus benefits and asking you to complete a short survey. Any data posted must be your own. You must follow the entry instructions as given on the Lidl Plus app, which shall also form part of these terms and conditions.

c) Once you have completed and submitted the Survey , in accordance with clause 2(b) above, you will automatically receive a coupon on your device via the Lidl Plus App “the Reward” by 23:59 on Friday 22 September 2023.

d) Lidl may from time to time use push notifications that you can enable to receive a notification on your device that you have a Reward available to use via the Lidl Plus app. Enabling push notifications is not a requirement to enter.

e) Only one entry is permitted per Participant. Second or subsequent entries will be disqualified. Syndicated entries or those made using methods such as a computer macro, a script or the use Entries on another individual’s behalf will not be accepted. Any other forms of entry, including but not limited to automated devices or processes, are not allowed and all such entries will be disqualified, and any prize awarded will be void. No entries from consumer groups, 3rd parties or bulk entries will be accepted.

f) Your Reward will be displayed shortly afterwards in the 'Coupons' section of the Lidl Plus app. The Reward will expire 7 days from receipt. The Reward can only be redeemed against future purchases at Lidl branches in Great Britain (excluding Northern Ireland) and in compliance with the Reward terms and conditions available when you click on the Reward in the Lidl Plus app.

g) Lidl reserves the right to substitute the Reward with an alternative reward of the same or higher value in the event that the original Reward offered is not available.

h) Lidl’s Rewards are non-exchangeable, non-transferable and no cash alternative is offered.

3) Rewards

a) The Reward is a £2 off coupon with a Minimum spend of £20 (excluding Infant Formula, Alcohol and Gift Cards). Coupon T&Cs apply.

b) The Reward is displayed as a digital coupon in the 'Coupons' section of the Lidl Plus app and is subject to the redemption criteria below and the Reward terms and conditions available when you click on the Reward on the Lidl Plus app. Note that the Rewards are not available in a physical format, and cannot be printed.

c) The redemption criteria for the Reward is as follows:

i) Rewards are only redeemable in Lidl branches in Great Britain (excluding Northern Ireland) by the Lidl Plus account holder who must be 18 years old or over;

ii) Rewards cannot be redeemed on purchases which have generated the coupon, or on purchases already made; they can only be redeemed on subsequent visits.

iii) Rewards must be activated by clicking an activate button and redeemed during the specified validity period (as stipulated in these terms and/or on the Reward);

iv) Rewards are non-exchangeable, non-transferable and non-refundable;

v) Rewards are not for resale or publication;

vi) Screenshots, pictures or online printouts of Rewards will not be accepted; only original Rewards within the Lidl App are valid;

vii) The full Reward discount must be used in a single transaction and alcohol, infant formula and gift cards do not count towards Reward spend amount. No change will be given;

d) Cannot be used in conjunction with a Reward which gives a discount on the overall spend in a single transaction and the product range specific discount will be applied to the transaction first.

e) Lidl reserves the right to replace the Reward with an alternative Reward of equal or higher value if circumstances beyond Lidl's control makes it necessary to do so.

f) Once a Reward expires or is redeemed, it automatically disappears from the Lidl Plus app. Redeemed or expired Rewards cannot be used or recovered.

4) Coupon Terms and Conditions

£2 off shopping when you spend £20 or more in a single transaction. Coupon valid for 7 days from receipt (actual dates shown on the coupon details in the Lidl Plus app). Alcohol, infant formula and gift cards do not count towards the spend amount. Must spend £20 to redeem. Cannot be used in conjunction with other Lidl Plus coupons which give a discount on overall spend in a single transaction. Cannot redeem on alcohol, infant formula or gift cards. Present coupon at time of purchase. Redeemable by Lidl Plus account holder, 18+ in Lidl GB branches. Screenshots, pictures or printouts not accepted; only original coupons within app are valid. Coupon value is 0.0001p, is non-exchangeable, non-transferable and non-refundable. Data charges may apply. Full coupon discount must be used, no change will be given. Coupon remains property of Lidl Great Britain Limited. Not for resale or publication. Proportion of total coupon discount will be deducted from each item purchased. If number of promotional items exceeds total coupon discount (in pence), proportion of total coupon discount will be deducted in scan order. Any refunds on items purchased using the discount will be refunded at the discounted price (with no credit refunded for the coupon or applicable portion of the coupon used on such item). 5) Liability

a) If we fail to comply with these terms we are responsible to you for loss or damage that you suffer which are a foreseeable consequence of us breaking these terms, or any losses or damage you suffer as a result of our failing to use reasonable care and skill.

b) We do not accept any responsibility to you:

i) if you are unable to access the Lidl Plus app to access Lidl’s Spin of Surprises and redeem Rewards due to there being no or limited WLAN connection available through your mobile device; or

ii) for any losses or delays in transmission of messages, Lidl’s Spin of Surprises and Rewards arising out of the use of any Internet access service provider or mobile network service provider or caused by any browser or other software which is not under our control.

c) We do not exclude or limit in any way liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors, for fraud or fraudulent misrepresentation or for failing to use our reasonable care and skill in providing the digital Lidl’s Spin of Surprises and Rewards.

d) We are responsible for damage to your property if the Lidl’s Spin of Surprises or Rewards we have supplied via the app damages a device or digital content belonging to you. We will either repair the damage or pay you compensation. However, we will not be liable for damage could have been avoided by following our advice to apply an update to the Lidl Plus app, for damage that was caused by you failing to correctly follow installation/download instructions or your unlawful use of the app.

e) Lidl accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.

6) Cancellation

a) Lidl reserves the right to void, cancel, suspend, or amend the Scheme without prior notice for reasons beyond its control. Lidl may make this decision:

i) for technical reasons (e.g. viruses in the system, manipulation or hardware or software failures, etc.); and / or

ii) for legal reasons, if the Scheme cannot be carried out in accordance with the Terms and Conditions of Participation,

we will let you know as soon as possible and take steps to minimise the impact.

b) If the cancellation is caused by unlawful and culpable conduct on the part of a Participant, Lidl has the right to claim compensation for any damage suffered.

7) Disqualification

a) Participants are deemed to have accepted and agreed to be bound by these Terms and Conditions of Participation by submitting the Survey. Lidl reserves the right to refuse entry, or refuse to award the Reward to anyone in breach of these Terms and Conditions of Participation.

b) Lidl reserves the right to exclude Participants without prior notice and to prevent their participation.

c) All users who use prohibited means for participation (e.g. hacking tools, viruses, Trojans, etc.) will be excluded.

d) Participation in the Scheme by groups of players, automatic services or professional services is not permitted.

8) General

a) The decision of Lidl regarding any aspect of the Scheme and is final and binding and no correspondence will be entered into about it.

b) Data charges may apply when using the Lidl Plus app.

c) The Scheme will be governed by English law and entrants to the Scheme submit to the jurisdiction of the English courts.
